L’échelle de juridicité : un outil pour mesurer le droit et fonder une théorie syncrétique (première partie : présentation)

Abstract : The object of the present contribution is not certainly revolutionary because it is about the eternal question of the definition of Law. However, the operated theoretical and epistemological choices are perfectly innovative and audacious. Indeed, it is suggested answering to this question by adopting a syncretic posture, by considering as valid all the significant theses and by trying to overtake them to establish "the" theory of Law. These presuppositions and their implications are detailed in the introduction. The study is also original by the fact that it suggests, then, "measuring the Law". Nobody has ever dreaded the legal phenomenon in terms of degrees of intensity. Classically, the jurists argue in a binary and Manichean way: either a standard is legal, or it is not legal. Nevertheless, nothing forbids the existence of semi-legal rules. The criteria and the method will be presented here and use to establish the level of Law of a rule.
