LA DOCTRINE FACE AU CONTRÔLE DE PROPORTIONNALITÉ IN CONCRETO COMME ILLUSTRATION D'UNE CONTROVERSE SUR LES MÉTHODES DU DROIT
Abstract
Since 2013, the French academic doctrine has dealt with a new phenomenon : the introduction of proportionality in the decisions of the Cour de cassation. Authors have adopted different opinions regarding the introduction of proportionality depending whether they considerer it compatible or not with the traditional function of the Cour de cassation. This article aims at questioning the dichotomies that structure the French academic discourse and putting into perspective a confusion between casuistry and case-by-case decision-making. More generally, the approach that I follow highlights the obstacles of rule based decision making in the presence of fundamental rights.
