Le droit sans le territoire – Globalisation et postmodernité juridiques

Abstract : According to more and more authors (the “postmodern” thought), the territory would not be any more a central figure of law. The global phenomenon would cause inevitably a globalization of law and, therefore, the disappearance of the borders. To end in this conclusion, these authors forget the Kelsen’s theory that, today, occupies still strongly a majority of jurists. If the classic law have not more than a partial role compared with others sources of rules, it is necessary to propose new theoretical and epistemological approaches. Especially, it seems required to have a sociological approach. Because it concentrates more on the effectiveness of the rules than on their validity, it brings to light the development of trans-territorial and private rules.
